Terms and Conditions
These Terms and Conditions ("Terms") outline the agreement between you ("Client") and Startups Australia DotCom, registered business under BUILDING CAPABILITIES PTY LTD ("Company") with ACN number 673 568 146, regarding your use of our services, including coaching packages and hourly consulting work.
Effective as of July 2024
1. Services
Startups Australia DotCom provides strategic support to entrepreneurs and startups at various stages of their business journey. Our services include:
Coaching Packages: We offer structured coaching programs tailored to your needs. Each package includes a specified number of coaching sessions, follow-up materials, and access to our coaches for ongoing guidance.
Hourly Consulting: You may engage our team for targeted consulting on specific challenges, including (but not limited to) business strategy, fundraising, operations, and marketing. Hourly sessions are booked in advance and billed accordingly.
2. Fees and Payment
Coaching Packages:
Fees for coaching packages are clearly stated on our website or communicated in writing. Full payment is required upfront before the first session commences.
Hourly Consulting:
Our consulting rate will be confirmed in writing prior to the engagement. Invoices are issued monthly and payable within 7 days.

All transactions must be in AUD unless otherwise agreed in writing.
4. Cancellations and Refunds
Coaching Packages:
Cancellations are subject to the terms specified in the selected package, which will be provided prior to enrolment. Missed sessions without notice are non-refundable.
Hourly Consulting:
Sessions must be cancelled with a minimum of 24 hours’ notice to avoid being charged in full.
5. Intellectual Property
All materials shared during coaching or consulting — including slides, templates, tools, and documentation — remain the intellectual property of Startups Australia DotCom unless otherwise agreed in writing.
Clients are granted a non-transferable, non-commercial licence to use these materials solely for internal business use. Redistribution or reproduction without permission is prohibited.
6. Confidentiality
Both parties agree to maintain strict confidentiality of any non-public, proprietary, or sensitive information disclosed during the course of the engagement (“Confidential Information”).
Neither party shall disclose Confidential Information to any third party or use it for any purpose outside the scope of the engagement without prior written consent, unless required by law. This obligation survives the termination of the engagement and remains in effect for two (2) years.
7. Disclaimer of Warranties
All services are provided “as is” and “as available.” Startups Australia DotCom makes no guarantees regarding business outcomes, funding success, or specific results from coaching or consulting sessions.
8. Limitation of Liability
To the fullest extent permitted by law, Startups Australia DotCom is not liable for any indirect, incidental, special, or consequential damages arising from your use of our services. Our total liability, if any, shall not exceed the amount paid by you for services rendered.
9. Entire Agreement
These Terms constitute the entire agreement between the client and Startups Australia DotCom. They supersede all prior agreements or communications, whether written or oral.
10. Governing Law
These Terms shall be governed and interpreted under the laws of Queensland, Australia.
11. Dispute Resolution
Any dispute arising from these Terms shall first be attempted to be resolved through mediation, using a recognised provider in Queensland. If mediation fails, the dispute may be escalated in accordance with applicable Australian law.
By engaging with Startups Australia DotCom services, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions.
